1. Agreement to Terms

By accessing or using the Easy Building Codes website and services (collectively, "the Service"), operated by Easy Building Codes ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you and Easy Building Codes. We may update these Terms from time to time, and the "Last updated" date above indicates when the most recent changes were made.

2. Description of Service

Easy Building Codes provides an AI-powered research and reference tool for Australian and United Kingdom building standards and regulations. The Service includes:

• AI-assisted chat for building standards queries
• Document upload and analysis for building compliance research
• Conversation history and saved research
• Team collaboration features for shared access

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

5. Account Registration

Certain features of the Service require you to create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information to keep it accurate
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorised use of your account

We reserve the right to suspend or terminate accounts that contain false information or that violate these Terms.

6. Free and Paid Plans

Free Access

Unregistered users may use the Service on a limited basis, subject to usage quotas. Free access is provided at our discretion and may be modified or withdrawn at any time without notice.

Paid Subscriptions

We offer paid subscription plans (including Day Passes, monthly, and annual plans) that provide additional features and higher usage limits. By purchasing a paid plan, you agree to the following:

• Billing: Subscription fees are billed in advance on the applicable billing cycle (daily, monthly, or annually). One-time purchases such as Day Passes are charged at the time of purchase.
• Automatic Renewal: Recurring subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
• Cancellation: You may cancel your subscription at any time through your account settings or via the customer billing portal. Cancellation takes effect at the end of the current billing period, and you will retain access until that date.
• Refunds: We offer a 7-day satisfaction guarantee on new subscriptions. If you are not satisfied, contact us within 7 days of your initial purchase for a full refund. No refunds are provided after the 7-day period or for partial billing periods. Day Passes are non-refundable once activated.
• Price Changes:We may change subscription prices with at least 30 days' notice. Price changes take effect at the start of your next billing period following the notice.

Team Plans

Team plans are billed per seat. The team administrator is responsible for managing team membership and is liable for all charges associated with the team account. Adding members increases the subscription cost proportionally.

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Redistribute, resell, sublicence, or provide commercial access to the Service without our prior written consent
• Use automated scripts, bots, scrapers, or other automated means to access the Service without our prior written permission
• Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service
• Interfere with, disrupt, or place an unreasonable burden on the Service or its infrastructure
• Circumvent any usage limits, access controls, or security measures
• Upload content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

8. Intellectual Property

Our Content

The Service, including its design, features, software, text, graphics, and other content (excluding user-submitted content), is owned by Easy Building Codes and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our content without our express written permission.

Your Content

You retain ownership of any documents, files, or other content you upload to the Service ("User Content"). By uploading User Content, you grant us a limited, non-exclusive licence to process, store, and analyse that content solely for the purpose of providing the Service to you. We do not claim ownership of your User Content and will not use it for any purpose other than delivering the Service.

AI-Generated Responses

Responses generated by the Service are provided for your personal or internal business use. These responses are generated using AI technology and may incorporate information from publicly available building standards and regulations. You may use AI-generated responses in your own work, but you acknowledge that such responses are not guaranteed to be accurate and should be independently verified.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in the Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Easy Building Codes, its directors, employees, agents, and affiliates shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, business opportunities, or goodwill
• Damages arising from reliance on information provided by the Service
• Costs or damages resulting from building decisions, non-compliance, or regulatory action
• Service interruptions, errors, omissions, or inaccuracies in content

In no event shall our total aggregate liability to you exceed the amount you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim, or one hundred Australian dollars (AUD $100), whichever is greater.

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, reliability, or completeness of any information provided through the Service.

12. Indemnification

You agree to indemnify, defend, and hold harmless Easy Building Codes and its directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any decisions made or actions taken based on information obtained through the Service

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination:

• Your right to access and use the Service will cease immediately
• We may delete your account data after a reasonable retention period (typically 30 days)
• Any outstanding payment obligations remain due
• Provisions of these Terms that by their nature should survive termination will survive, including Sections 3, 10, 11, 12, and 15

You may terminate your account at any time by deleting your account through your profile settings.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice by updating the "Last updated" date and, where practicable, by sending you an email or displaying a notice within the Service. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of Victoria, Australia, for the resolution of any disputes arising out of or relating to these Terms or the Service.

16. General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Easy Building Codes regarding the Service.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
• Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
• Force Majeure: We are not liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including natural disasters, government actions, internet or infrastructure failures, or third-party service outages.
